Net.), it’s admins or operators and the Berlin4Beginners (B4B) Facebook group (“https://www.facebook.com/groups/berlin4beginners”) owned by Facebook Inc., created and administered by Afropunk Carol.
Your access to and use of Berlin Social Network is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use Berlin Social Network.
By accessing or using Berlin Social Network you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access Berlin Social Network.
Limited License
Berlin Social Network grants you a non-exclusive, non-transferable, revocable license to access and use our Website in order for you to view and publish content and make purchases of electronic services through our Website, strictly in accordance with our Terms.
Berlin Social Network also grants you non-exclusive, non-transferrable, revocable access to the “Berlin4Beginners” Facebook group in order for you to view and publish content according to our Community Guidelines and in accordance with our Terms.
Termination
Access to Berlin Social Network is provided on a temporary basis. We may terminate or suspend access to Berlin Social Network immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Access
We refer to any individual or organisation that uses Berlin Social Network as “Users”.
If you register with Berlin Social Network you will be setting up an account with us (“Account”) and may be able to create your own profile. (“Profile”)
We do not guarantee that Berlin Social Network will be available at any particular time or for any particular period of time. From time to time we may restrict access to all or part of Berlin Social Network with or without notice.
Registration & Security
During registration, you will choose a user name and also need to select a password that you can use to access your Account. It is your responsibility to maintain the confidentiality of your password and user name. You are responsible for all activities carried out on your account. We do not have the means to verify the identities of our users and will not be liable where your password or username is used by someone else.
Registration involves signing up for an Account which can take up to 48 hours to process and be approved and administered. This can result in a lag between the time that you sign up and the time that your posts start being approved. Once you have signed up and/or paid for a premium account, if your posts are not yet being approved, please wait 48 hours before contacting support. At which point if your posts are still not being approved please email support@berlinsocial.network for assistance.
Premium Digital Services & Subscriptions
Premium subscription or payment is not required for the general use of Berlin Social Network however we do offer services and subscriptions for sale on the website which may be purchased at any time by you.
Digital Services (“Services”) refer to premium digital purchases for a one off or recurring cost relating to the provision of services rendered by Berlin Social Network including, but not limited to, online courses, content moderation, administration of promotional content, promoted content, communications with our members, advertising and other services we may offer from time to time.
Digital Subscriptions (“Subscriptions”) refer to premium digital purchases on an automatic recurring basis, usually monthly or annually relating to the continued provision of services rendered by Berlin Social Network including, but not limited to, online courses, content moderation, administration of promotional content, access to premium content, access to premium services and other services we may offer from time to time.
Pricing
We reserve the right to change the price of any of our Services or Subscriptions at any time without notice. A change in price of any of our services or subscriptions does not obligate you to continue using or paying for that service and you may terminate your agreement with us at any time with 30 days written notice.
Cancellations
By placing an order with us for a Service or Subscription you are entering into a contract with us. You have the right to cancel that contract within 14 days of purchase for a Service or Subscription. After 14 days of the purchase of a Service there will be no Refunds or Cancellations. After 14 days of the purchase of a Subscription you may cancel your contract at any time. “Pausing” And Cancelling Subscriptions
For your convenience we allow Subscriptions to be temporarily suspended (“Paused”, “Pausing”) or cancelled outright. This is managed through your own account area. Pausing your subscription keeps your account active but temporarily suspends your billing cycle so that you will not be charged until your subscription is resumed. This temporary suspension period may be indefinite but we reserve the right to change this temporary period at any time and automatically resume your billing with 30 days notice. You may resume your own subscription at any time. If you choose to cancel your subscription your account will immediately become inactive, you will no longer be billed and any services remaining that would have been rendered within your billing period are forfeit.
We reserve the right to suspend your services as soon as you pause your account and, at our discretion, charge you the full, non-subscription price for any services rendered up until that point.
Refunds
We begin providing our services as soon as you place your order and by placing an order you are requesting that we do so. Your right to cancel and request a refund will only apply to services that have not yet been provided at the time of your request. If you request to begin the performance of services during the cancellation period, you shall pay us an amount in proportion to what has been performed up until you communicated your cancellation from the contract. In other words, we will reimburse to you all payments received in respect of services not yet provided but we are entitled to retain payments or part payments relating to services already provided during the period. We will make any reimbursement using the same method of payment used for the initial transaction.
REFUNDS WILL NOT BE PROVIDED FOR ANY SUBSCRIPTION. WE DO NOT PROVIDE CREDIT, REFUNDS OR PRO-RATED MONTHLY BILLING FOR SUBSCRIPTIONS THAT ARE CANCELLED MID TERM. In such circumstances, you will have access to your subscription until the end of the billing cycle or in the case of yearly billing the end of the month at which point you will receive a pro-rated reimbursement for the remainder of the year unused.
Unlimited Accounts & “Fair Usage Policy”
From time to time Berlin Social Network may offer certain services for you to purchase as “unlimited”. Whilst we do not actively cap the usage of any unlimited accounts we do require your usage to remain within a reasonable range of Fair Usage so that the experience of all our members, both paying and non-paying, is not effected negatively. For advertising subscriptions, publishing to the community, we consider fair usage to be four advertisements per week, or sixteen per month on average. If this fair usage policy is breached we reserve the right to limit the rate of your posts or cancel your account entirely at which point all money paid for the current billing period is forfeit.
Deleting your old posts, or any other activity seen to be conducted to contravene this fair usage policy may result in the immediate suspension of your account.
Copyrights and Trademarks
Unless otherwise noted, all materials including without limitation, logos, brand names, images, designs, photographs, video clips and written and other materials that appear as part of our Website are copyrights, trademarks, service marks, trade dress and/or other intellectual property whether registered or unregistered (“Intellectual Property”) owned, controlled or licensed by Berlin Social Network. Our Website as a whole is protected by copyright and trade dress. Nothing on our Website should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Intellectual Property displayed or used on our Website, without the prior written permission of the Intellectual Property owner. The names and logos of Berlin Social Network, may not be used in any way, including in advertising or publicity pertaining to distribution of materials on our Website, without prior, written permission from Berlin Social Network. Berlin Social Network prohibits use of any logo of Berlin Social Network or any of its affiliates as part of a link to or from any Website unless Berlin Social Network approves such link in advance and in writing. You also acknowledge that the use of Berlin Social Network to promote your company or business DOES NOT constitute an endorsement of your company or business by Berlin Social Network and we are under no obligation to publish, promote or otherwise publicly acknowledge any business relationship outside of what is offered as part of our core Services and Subscriptions. We can, at any time now or in the future, use your Branding in the advertising and promotion of our Services and Subscriptions without incurring any fee, charge or obligations including but not limited to attribution, outbound linking, or written notice to you or any of our Users. We will never add, distort or change any branding, logo or other trademarks associated with your business or company intentionally and we will always endeavor to use the most up to date version of your branding whenever possible but we cannot be held responsible or liable for inaccuracies, mistakes, misrepresentations or other out of date representations of your Branding.
